Welcome to the Torchwood Hosting AI Music Marketplace. These Customer Terms of Service ("Terms") govern customer accounts, purchases, downloads, music previews, and other customer use of this marketplace (the "Service"). By creating a customer account, purchasing music, downloading content, or otherwise using the Service, you acknowledge that you have read and agree to these Terms.
1. Customer Accounts
You are responsible for maintaining the confidentiality of your account credentials and for activity performed through your account. You agree to provide accurate information when creating and maintaining your account. You may not use another person's account without permission or create or use accounts for fraudulent, abusive, or unlawful purposes.
2. Digital Music Purchases
Music sold through this marketplace is provided as digital content. Purchasing a track or album gives you a personal license to download and listen to the purchased music. Purchasing music does not transfer copyright or ownership of the music to you. Unless the artist or copyright owner expressly grants additional rights, purchased music is for your personal, non-commercial use only.
3. ALL SALES ARE FINAL
ALL SALES ARE FINAL.
Because products sold through this marketplace are digital goods that can be accessed or downloaded after purchase, we generally do not offer returns, exchanges, or refunds once a purchase has been completed.
Please review the track or album information and listen to available previews before purchasing.
A refund or other remedy may be provided when required by applicable law or when Torchwood Hosting determines that exceptional circumstances warrant one, such as an erroneous duplicate charge or a technical failure that prevents delivery of purchased content. Nothing in these Terms is intended to waive consumer rights that cannot legally be waived.
4. Music Previews
Music previews are provided to help customers evaluate music before purchasing. Previews may represent only a portion of the complete recording. The availability or length of a preview does not grant permission to copy, record, redistribute, or otherwise use the preview outside the marketplace.
5. Downloads
Purchased music may be made available through your customer account and music library. You may download purchased content for your own personal use. You may not intentionally share your account or download links with others to allow them to obtain music without purchasing it.
We recommend keeping your own backup copies of legally downloaded purchases. We cannot guarantee that every purchased file will remain available for re-download indefinitely.
6. Copyright and Intellectual Property
Artists and other applicable rights holders retain ownership and copyright in music offered through the marketplace. A purchase does not give you permission to resell or redistribute the music, upload it to file-sharing or download services, claim it as your own creation, deceptively remove or alter ownership information, license or sublicense it to another person, use it commercially without separate permission, or make the purchased file publicly available for others to copy or download.
Unauthorized copying or distribution may violate copyright and other applicable laws.
7. Artist Content
Music available through the marketplace is uploaded and offered by individual artists. Artists are responsible for representing that they have the rights necessary to upload and sell their content through the marketplace. Torchwood Hosting may remove or restrict access to content when it receives a credible copyright complaint, discovers a violation of marketplace rules, or otherwise determines that removal is necessary.
8. Pricing
Prices are displayed before checkout. Prices may be changed by an artist or marketplace administrator for future purchases. A later price change does not alter the price of a previously completed transaction. Some music may be offered as a free download.
9. Payments
Payments may be processed through third-party payment providers such as PayPal. When using a third-party payment provider, you may also be subject to that provider's applicable terms and privacy practices. Torchwood Hosting does not require customers to provide their PayPal password to this marketplace.
10. Unauthorized or Fraudulent Transactions
You agree not to use stolen payment information or make fraudulent purchases. If you believe your account or payment method has been used without authorization, contact us as soon as possible and contact your payment provider when appropriate.
We reserve the right to suspend accounts associated with fraud, payment abuse, chargeback abuse, unauthorized transactions, or other suspicious activity while the matter is investigated.
11. Prohibited Conduct
You may not use the marketplace to engage in unlawful activity, interfere with marketplace security or operation, attempt to bypass purchasing or download controls, gain unauthorized access to another account, distribute malicious software, scrape protected content, or abuse marketplace services.
12. Service Availability
We work to keep the marketplace and purchased-content services available, but uninterrupted operation cannot be guaranteed. Maintenance, technical failures, network problems, security incidents, third-party service interruptions, or circumstances outside our reasonable control may temporarily affect availability.
13. Account Suspension or Termination
We may suspend or terminate an account for fraud, abuse, security threats, repeated violations of these Terms, unlawful activity, or other serious violations of marketplace policies. Termination of an account does not grant rights to redistribute previously purchased content.
14. Limitation of Liability
To the maximum extent permitted by applicable law, Torchwood Hosting is not responsible for indirect, incidental, special, consequential, or similar damages arising from use of the marketplace. Nothing in these Terms excludes or limits liability or consumer rights where doing so would be prohibited by applicable law.
15. Changes to These Terms
These Customer Terms of Service may be updated as the marketplace, payment systems, legal requirements, or services change. The current version will be posted on this website with its effective or updated date. Continued use of the marketplace after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.
